The clarification of the terminology has been planned and discussed for a long time. Now the EU Commission has presented two new regulations.

 

The Commission's aim was to align the definition of "pesticide residues" in the special legislation for baby food with that of Regulation (EC) 396/205 on maximum residue levels of pesticides in or on food and feed of plant and animal origin. In this regulation, the definition of "pesticide residues" includes not only pure pesticide active substances but also those that are also used as biocides or veterinary medicinal product active substances. In future, the definition will therefore be based on Article 3(2)(c) of Regulation (EC) No 396/2005. For complementary foods, on the other hand, the original definition still applies, which relates (only) to pesticide residues.

Annex IV of the delegated regulations lists the substances for which a maximum residue level < 0.01 mg/kg applies. Annex V lists the prohibited plant protection product active substances. They are not permitted for the cultivation of plants for the production of baby food. For the substances in Annex IV and V, the residue definitions have been aligned with those of Regulation (EC) No 396/2005. Both regulations entered into force on 7/15/21 and apply without transitional arrangements from that date. (FM)
